FOR A GENERAL RATE INCREASE FOR WASTEWATER SERVICES FOR THE CUSTOMERS OF THE PLANTATIONS RESIDENTIAL COMMUNITY WASTEWATER SYSTEM (FILED NOVEMBER 7, 2012) PSC DOCKET NO. 12-497 PSC DOCKET NO. 12-498WW NOTICE OF PUBLIC COMMENT SESSION TO: ALL RESDIENTS,OF THE PLANTATIONS RESIDENTIAL COMMUNITY WASTEWATER SYSTEM AND OTHER INTERESETED PARTIES A Hearing Examiner of the Delaware Public Service Commission ("the Commission") will conduct a Public Comment Session at which members of the public may provide their views regarding the subject Applications, at the followin( date/time and location: I Cape Henlopen High School- [ Thursday, February 21, 2013 Theater [ 7 p.m. 1250 Kings Highway I Lewes, Delaware 19958 I" On November 7, 2012, YMG Corporation, ("YMG") a Delaware corporation and Delaware regulated public utility, and Tidewater Environmental Services, Inc., CTESI") a Delaware corporation, filed with the Delaware Public Service Commission ("the Commission") Applications requesting the Commission to approve the transfer and assignment by YMG to TESI of substantially all of its assets and regulatory authorizations, including its Certificate of Public Convenience and Necessity CCPCN") authorizing YMG to provide wastewater treatment services to the residents of the residential development known as "the Plantations" located in Rehoboth Beach, Delaware. If approved to serve the Plantations' residents, TESI, an affiliate of Tidewater Utilities, Inc., would thereafter be regulated by the Commission regarding the Plantations' development. If approved, TESI would be authorized to provide wastewater treatment services to Plantations' residents pursuant to the authority in the CPCN granted to TESI by the Commission. TESI's proposed purchase of YMG's assets is contingent upon the resolution to TESI's satisfaction of an administrative penalty in the aggregate amount of $233,818 assessed by the Department of Natural Resources and Environmental Control ("DNREC") against YMG in February, 2011 for allegedgly failing to operate the Plantations' wastewater system in compliance with Delaware law. DNREC has agreed to eliminate this penalty.if YMG's assets and CPCN are transferred to TESI. If TESI &cquires YMG's assets, TESI has also agreed to accept the responsibility and the cost of resolving the DNREC penalty. Upon acquiring YMG's assets, TESI has agreed to assume full responsibility and cost for resolving any other compliance issues associated with the DNREC's administrative costs and the operation of the acquired assets, including any required system upgrades. TESI's purchase of YMG's assets would include the wastewater treatment plant, sewer lines and licenses relating to the Plantations' development. TESI's obligation to purchase YMG's assets is contingent upon approval by the Commission of an increase in the rates currently charged by YMG to Plantations' customers, which have been in effect since October 2005. TESI is seeking an increase in annual operating revenues of approximately $89,000 over current revenues of approximately $2351000, or a 37.01%.increase. According to the provisions of 26 Del. C. 215, the Commission has determined that this Application shall be the subject of further investigation, and that a Public Comment Session and Public Evidentiary Hearing shall be held before the Commission makes its final decision. At the Public Comment Session, members of the public may )rovide their views concerning the Applications, the proposed rates and the service being provided. The Evidentiary Hearing conducted by the Commission will be scheduled at a later date. The Commission's final decision will be based on the evidence presented at the Evidentiary Hearing. Parties to the proceeding may )resent formal evidence at the Evidentiary Hearing. In addition, the Evidentiary Hearing may involve consideration of any Settlement Agreement proposed by some or all of the parties. The Commission's final determination on the Applications will be based on the record developed in these proceedings..
