46 - CAPE GAZE'FEE - Friday, Feb. 24 - Monday, Feb. 2"/, 2006 Edith.', How do I report inappro- priate actions of an agent? To make a long story short, my par- ents had a difficult time selling their home. In the end, the agent bought it for a lot less than the asking price. She also received full commission. She insisted she was buying the home to live in, yet we think she is going to put it back on the market. We question if she ever made full effort to sell, knowing that she wanted to buy. Is this appropriate action in your opinion? I think someone should be made aware of her actions. Who should I contact? - C.H. Dear C.H.: If the agent was not the managing broker in that com- pany, then her supervising broker is the first person to talk with about the matter. Then you can contact the local Association of Realtors. That's a private organization concerned with the ethical practices of its members. I'm assuming this agent belongs; most local brokers do. To make more trouble, your folks can take a complaint to their state's real estate commission, which issues licenses. To be fair, if the house was mul- tiple-listed, many brokers had a chance to market it to their buy- ers, and evidently they didn't. HOUSE CALLS Edith Lank Edith Lank is a past direc- tor of the National Associa- tion of Real Estate Editors and the Real Estate Educators Association. She will personally respond to any questions sent to her at 240 Hemingway Dr Rochester, N.Y. 14620. Include a stamped return envelope. She also accepts email at Add to that the fact that'your folks had a difficult time selling, and we must suspect their asking price was too high, much more than market value. So perhaps they weren't cheat- ed on the price. Some experts on the law of agency, though, believe that the agent who buys property while collecting a commission is prac- ticing illegal dual agency, with a conflict of interest. You may want to consult a lawyer who specializes in real estate, but remember that an attor- ney's first question is often, "What are you trying to accom- plish?" Do you simply want to make trouble for the agent? Try to have her licerise taken away? Reclaim the amount of the commission? Bring in an appraiser for market value and sue for any difference in price? Cancel the sale and take the house back? You'll want to have an answer ready. He has survivorship Dear Edith: Nine years ago, my daughter and her boyfriend bought a house together; they have two biological children. In October 2005, he moved out, and by November, he married another woman. He and my daughter never mar- ried, but they lived together for 17 years. They have a sole survivorship deed, and he refuses to give up the property. We have consulted two attorneys, and both suggested that she allow the home to go into foreclosure. My daughter refuses and con- tinues to make the mortgage pay- menUs. What recourse does she have? - A. Dear A.: With a survivorship deed, if her children's father dies, your daughter gets the whole house automatically. Of course, it works the other way around. If she dies first, the house goes to him. But as long as they are both alive and she lives in the house, what difference does it make if he's half-owner? Unless he's trying to sell the house out from under her, I don't see the problem. Rentals don't pay Dear Edith: We own three rental houses. Currently, two are not rented, and we are having trouble meeting mortgage pay- ments.
