Sussex County, a political subdivision of the State of Delaware, brings this action under the power of eminent domain for the acquisition of property for public use and for the award of just compensation therefore to the owner or owners and to any other parties in interest. 2. The authority for the taking is tle 9, Chapter 67, Section 6702(1), of the Delaware Code Revised 1974. 3. The property to be taken is a permanent utility easement in land described as follows: ALL that certain street, road, right of way and cul-de-sac known as 'Nelsa Lane" as depicted on a plot of "The Meadows" dated September 6, 1985 and recorded in the Office of the Recorder of Deeds, in and for Sussex County at Plot Book 33, Page 317. 4. The use for which this property is taken for the connection of the lots within "The Meadows" subdivision to Sussex County's Oak Orchard Sanitary Sewer District. 5. In the judgment of Sussex County, said easement is necessary in order to undertake th e necessary construction of the Oak Orchard Sanitary Sewer District. 6. Pursuant to a deed recorded in the Office of the Recorder of Deeds in and for Sussex County at Deed Book 708 Page 268 dated September 6, 1985, title in the property is vested in the name of Defendant, Oak Meadows, Inc. A copy of said Deed is attached hereto as Exhibit A. 7. The Plaintiff has attempted to contact the Defendants to acquire the easement by negotiation. See Affidavit of Necessity of Michael A. Izzo, P.E., attached hereto as Exhibit B. 8. To the best of Plaintiffs knowledge, oak Meadows, Inc., although record owner of the subject property, is no longer a corporation in good standing, or have a mailing address. The Plaintiff has been unable to acquire the property by negotiation. 9. Based upon inquiries made with property owners along Nelsa Lane, there is no objection to signing an easement, but since the Defendant's corporation is defunct, property owners state that they have no authority to sign such a document. 10. The interest to be acquired bythe Plaintiff as to the property described in Paragraph 3 herein is a Permanent Utility Easement interest free and clear of all liens and encumbrances whatsoever. 11. The appraised value of the easement is $1.00. See Appraisal from Harold L. Carmean, M.B.A., attached hereto as Exhibit C. 12. Plaintiff has deposited $1.00 with this Court, representing just compensation for the easement, as based upon the highest fair market value as set forth in the Appraisal. WHEREFORE, Plaintiff prays that judgment be entered condemning the said property, the just compensation therefore be ascertained and awarded to those having the right thereto, and such other relief be granted as may be just and proper. The Applicant proposes to use the funds to make leasehold improvements for the purpose of relocating Linus Tooling Inc. from Pennsylvania to an existing facility located at 108 Park Avenue in Seaford, Delaware. 4. AoDIioant: US LUBES LLC - The Applicant is requesting a loan in the amount of $200,000 from the Delaware Strategic Fund. The Applicant proposes to use the funds to renovate an existing building located in New Castle, Delaware and for the purchase of machinery and equipment. 5. A Dblicant: E. I. DuPont De Nemours and Com Danv - DuPont Photovoltai Solutions - The Applicant is requesting a grant in the amount of $1,090,000 from the Delaware Strategic Fund. The Applicant proposes to use the funds to renovate an existing building located in New Castle, Delaware and for the purchase of machinery and equipment. 6. Am)_ licant: Association of Educational Publishers - The Applicant is requesting a grant in the amount of $50,000 from the Delaware Strategic Fund. The Applicant proposes to use the funds for building renovations, purchase of new machinery and equipment, furniture and fixtures, IT upgrades and equipment and for moving expenses for its facility located at 300 Martin Luther King Ddve in Wilmington, Delaware. 7. Apollcant: Delaware City_ Refinery_ Com Dany LLC - The Applicant is requesting a convertible loan from the Delaware Strategic Fund program in the amount of $20,000,000. The Applicant proposes to use the funds to restart the Refinery and also make critical infrastructure improvements for future operations at the formedy known Valem Refinery located in Delaware City, Delaware.
