NOW THEREFORE BE IT RESOLVED, that a public hearing shall be held on Thursday, the 11th day of May, A.D. 1995, at 7:30 o'clock in the evening, at City Hall, East Third Street, Lewes, Sussex County, Delaware, to consider amending the City of Lewes Zoning Ordinance as fol- lows: (a) To amend Section 197- 1, Chapter 197, the Code of the City of Lewes, by stdking out all of the definition for "ACCESSORY BUILDING OR USE" end substituting in lieu thereof a new definition of "ACCESSORY BUILD- ING OR USE" to read as fol- lows: SeCtion 197-1. Terms defined; word usage. ACCESSORY BUILDING OR USE. A building or use customarily incidental and subordinate to an accessory to the principal building or use end located on the same lot with the principal use; provided, however, that any accessory building shall not exceed the following size and height restrictions and that any accessory building or use shall not have any of the following facilities: (1) Size of accessory build- ing shall not exceed nine hundred (900) square feet for the first floor and twenty- four (24) feet in height and shall not exceed one and a half (1 1/2) stories of which the first floor ceiling height shall not exceed eleven (11 ) feet measured from grade, the average of the finished ground level adjoining the building. (b) To amend Section 197- 1, Chapter 197, the Code of the City of Lewes, by renum- bering subparagraphs under Accessory Building or Use numbered (1) to read (2); subparagraph (2) to read (3); and subparagraph (3) to read (4). (c) To amend the Table of District Regulations, Chapter 197, the Code of the City of Lewes, by adding to the maximum height category (feet) of the R-1 District a new footnote number (16). (d) To amend the Table of District Regulations, Chapter 197, the Code of the City of Lewes, by adding to the maximum height category (feet) of the R-2 District a new footnote number (16). (e) To amend the Table of District Regulations, Chapter 197, the Code of the City of Lewes, by adding to NOTES, ;a new footnote (16) to read as follows: (16) For the R-1 Residen- tial District and for the R-2 Residential District, the height of any accessory building shall not exceed twenty-four (24) feet. (f) To amend the Table of Distdct Regulations, Chapter 197, the Code of the City of Lewes, by adding to the maximum height category (stodes) of the R-1 District a new footnote number (17), (g) To amend the Table of District Regula6ons, ter 197, the Code of the City of Lewes, by adding to the maximum height category (stodas) of the R-2 District a new footnote number (17). (h) To amend the Table of Distdct Regulations, Chapter 197, the Code of the City of Lewes, by adding to NOTES, a new footnote (17) to read as follows: (17) For the R-1 Residen- tial District and for the R-2 Residential District, the num- ber of stodas of any acces- sory building shall not exceed one and a half (1 1/2) stories. (i) To amend Section 197- 1, Chapter 197, the Code of the City of Lewes, by striking out all of the definition for =STORY, HALF" and substi. tuting in lieu thereof a new definition of "STORY; HALF" to read as follows: Section 197-1. Terms defined; word usage. STORY, HALF - A space under a sloping roof which has the line of intersection of roof decking and wall face not mare then three (3) feet above the to floor level and in which space not more than two-thirds (2/3) of the floor area is finished for use. A "half stdry" containing liv- ing quarters shall be counted as a full story.
