"Upon arriving home, the student's mother con- fronted her and in an attempt to trick her, stated that someone's wife had called looking for her husband," stated the probable cause statement. The court document stated the teen eventually admitted to her parents she had begun a relation- ship with Wolak March 25, when the pair allegedly were together at Delaware Seashore State Park. Four. sexually related incidents allegedly followed: two in state parks and two in Wolak's home. Court papers indicated only two occasions involved sexual inter- course. The victim's parents contacted Lewes Police Department April 10, after their discussion with their daughter. Det. Pat Quigley began an investigation that indi- cated two police jurisdictions were involved. "Mr. Wolak coop- erated with us from the first time we contacted him," said Quigley. "Throughout the investigation, as it proceeded, he continued to cooperate. You never want to be involved in something like this, and it's a shame it came to this." Delaware's law pertaining to sex between an adult and minor older than 16 and younger than 18 changed approximately a year ago. Prior to the legislative change, it was not a crime for an adult to have a consensual sexual relationship with a 17-year-old. The law now makes it a crime for someone "in a position of trust, authority or supervision over the child" to intentionally engage in sexual intercourse if the victim is under 18 and the defen- dant is older than 30. "The fourth-degree rape statute was enacted to address incidents like this," said Lt. John Yeomans, state police spokesman. "The goal was to protect the victims who might otherwise be taken advantage of by people in posi- tions of trust who maintain a sig- nificant age difference between the accused and the victim," Wolak, was arraigned in Court 2, where be was released on $50,000 secured bond, pending a preliminary hearing April 27, in the Court of Commop Pleas. Vickers declined comment on the case and advised Wolak against commenting publicly. Delaware law allows for a max- imum sentence of 10 years imprisonment for a Class C felony conviction. "I hope for all the families involved there can be some clo- sure and resolution to things, and they can go on with their lives," said Quigley.
