NOTICE OF SPECIAL ELECTION TO AUTHORIZE A DECREASE OF TAXES LEVIED TO PAY FOR DEBT SERVICE ON BONDS AND THE LEVY OF INCREASED TAXES BY THE SAME AMOUNT FOR SCHOOL PURPOSES, RESULTING IN NO INCREASE IN THE TAX RATE; AND THE TRANSFER OF TAX FUNDS, ALSO RESULTING IN NO INCREASE IN THE TAX RATE Reduction of Taxes to Pay for Bonds and Levy of Taxes in the Same Amount for School Purposes A special election will be held on June 12, 2008, in the Cape Henlopen School District, in accordance with the provisions of Section 1908(b) of Title 14 of the Delaware Code, in order to permit district voters to vote for or against a decrease of taxes by 8 cents per $100 of assessed valuation levied to pay for the principal and interest on bonds and the levy and collection of 8 cents per $100 of assessed valuation effective July 1,2008, to be used for current expenses for school purposes, with no increase in the tax rate. This decreaseincrease includes the 10 percent for delinquencies and costs of collection as required by law. Income from the levy shall be used to offset a portion of the reduction in the level of state funding provided to the district. This decreaseincrease will enable the district to avoid the loss of existing instructional staff and/or programs caused by state cutbacks, with no increase in the tax rate. Transfer of Tax Funds The special election to be held on June 12, 2008, will also include an election, in accordance with the provisions of Section 1908(b) of Title 14 of the Delaware Code, to authorize the transfer of $1,600,000 in tax funds received to pay principal and interest on bonds to the current expense account for school purposes in order to fund the construction of a synthetic-turf hockey and soccer field with lighting and stadium seating, also resulting in no increase in the tax rate. The polls for the special election shall be open on June 12, 2008, between the hours of 10 a.m. Eastern Standard Time and 8 p.m. Eastern Standard Time in the*following locations: Cape Henlopen High School, Mariner Middle School, and Rehoboth Elementary School. Any individual qualified to vote in this election may vote by absentee ballot if the voter is unable to appear at a polling place on June 12, 2008, for any of the following reasons: (1) temporary or permanent physical disability, (2) public service for the United States or the state of Delaware, (3) spouse or dependent of, and residing with or accompanying, a person in public service of the United States or the state of Delaware, (4) engagement in a business or occupation precluding appearance at a polling place, (5) sickness, (6) the tenets or teaching of the voter's religion, (7) incarceration, or (8) absence from the district while on vacation. Such a qualified person may vote by absentee ballot, provided the voter executes an affidavit of eligibility on the form prescribed by the State Department of Elections and delivers the affidavit to the Sussex County Department of Elections by 12 noon on June 11,2008. Upon timely receipt of the executed affidavit of eligibility, the Department of Elections shall deliver a ballot to the voter if the voter personally appears at the Department of Elections. If the voter instructs the Department of Elections to mail the ballot to the voter, the affidavit must be received by the Department of Elections no later than 12 noon on June 6, 2008. All absentee ballots must be returned to the Department of Elections, or a district polling place, by no later than 8 p.m. on June 12, 2008. All citizens of the state of Delaware who reside in the Cape Henlopen School District and who are 18 years of age or older (by federal law) are eligible to vote.
