Denn fines insurance company for mailing that appeared to be a government document A life insurance company that mailed a solicitation in an official- looking envelope from the "Office of the Senior Resource Center" will pay a $10,000 fine, will stop using such mailings and will allow any Delawarean who pur- chased a policy from the mailing get a refund if they choose, Insurance Commissioner Matt Denn announced Wednesday, July 19. The agreement came after Denn filed a formal complaint against Physicians Life Insurance Company of Omaha, Neb. earlier this month in which he said the company intended the mailing to look like a U.& government doc- " ument. "This fine and cease-and-desist order show that we will not toler- ate insurance companies using deceptive practices to sell, espe- cially when the target is senior cit- izens," Denn said. "I urge Delawareans to be wary about what they get in the mail and to notify the Department of Insurance if they receive some- thing from an insurance company that crosses the line." The cease-and-desist order to which Physicians Life agreed requires the company to: Immediately stop the use of any such mailings; Provide the names and addresses of Delawareans who received the mailings to the Insurance Commissioner's office; Provide the names and addresses of any Delawareans who responded to the solicitation: Notify any Delawareans who responded to the mailing that they have the opportunity to revoke their purchase and receive a free refund; Pay a $10,000 fine; and Submit future mailings from the company to Delawareans to the Commissioner for review for a period of one year. Besides listing a return address as "Office of the Senior Resource Center." the envelope containing the solicitation also has "Official Business" on its front and an American flag. The first page of the enclosed letter includes a series of boxes similar to Internal Revenue Service and Social Security Administration docu- ments, as well as'notations such as "Benefit Notice Memorandum: Notice of Eligibility for Individual Supplemental Death Benefits," "Form XLXJ-0606" and "Urgent ^ Please Take Action By: July 3, 2006." A scheduled July 27 hearing into the matter will no longe r take place.
