HOUSE BILL NO. 74 AN ACT PROPOSING AN AMENDMENT TO ARTICLE III. SECTIOII 00FTHE DELAWARE CONSTITUTION OF 1897 AS AMENDED, RELATING TO A RESIDENCY REQUIREMENT FOR THE SECRETARY OF STATE. BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (two.thirds of all members elected to each' house thereof concurring therein): Section 1. Amend Article III, 10 of the Delaware Constitution of 1897, as amended, by adding the follow- ing new sentence at the end of the existing paragraph: "The Secretary of State shalf becorne a bona fide resident of the State within six months after his or her appointment; pro'ded, however, that upon good cause shown, the Governor may grant an additional extension of six months. After becoming a resident of the State, the Secretary shall continuously be a resident of the State as long as he or she retains office. FaifiJre to obtain or retain such residency shall be an automatic resignation from office: SYNOPSIS This is the first leg of a proposed Constitutional Amendment to require the Secretary of State to be a resident of the State of Delaware within six months of his or her appointment. An additional extension may.be granted by the Governor upon good cause. Failure to obtain (or maintain) residency constitutes an automatic resignation from office SENATE SUBSTITUTE NO. 1 FOR SENATE BILL NO. 368 - AS AMENDED BY SENATE AMENDMENT NO. 1 AN ACT PROPOSING AN AMENDMENT TO 22 AND 23, ARTICLE III, AND ARTICLE IV OF THE DELAWARE CONSTITUTION OF 1897, AS AMENDED, RELATING TO THE APPOINTMENT BY THE COURT OF CHANCERY OF A REGISTER IN CHANCERY AND THE POWERS AND DUTIES OF THE REGISTER OF CHANCERY. BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE; Section 1. Amend 22, Article III, of the Delaware Constitution of 1897, as amended, by deleting the words "Registers in Chancery" as the same appear therein Section 2. Amend 23, Article III, of the Delaware Constitution of 1897, as amended, by deleted the words "Registers in Chancery" as the name appear therein. Section 3. Amend Article IV of the Delaware Constitution of 1897, as arrded, by adding a new Section to be designated as "Section 25" thereto to read as follows: " 25. Chief Register in Chancery: Appointment; Powers and Duties. The Court of Chancery shall appoint a Chief Register in Chancery to hold office at the pleasure of that Court. The Chief RSgister in Chancery shall be the Clerk of the Court of Chancery and shall appotnt, with the concurrence of the Court, a Register in Chancery in each county who shall also serve at the pleasure of the Court.The Chief Register in Chancery may also appoint other deputies, issue process, and enter judgement and do such other things as are accord- ing to law and the practice of the court." Section 4. Any person elected and commissioned as a Register in Chancery as of the effective date of this legislation shall continue to hold the respective office for the full term for which such person was elected; provided, how- ever, that a vacancy in the office after the effective date of this legislation by reason of ineligibility, death, resignation, or otherwise'shall be filled by appointment of the Court of Chancery or left vacant if the Court so determines. HOUSE BILL NO. 593 AN ACT PROPOSING THE AMENDMENT OF ARTICLE IV OF THE CONSTITUTION OF THE STATE OF DELAWARE BY THE ADDITION OF ANEW SECTION 39 CREATING THE JUDICIAL OFFICE OF SENIOR JUDGE. BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE: (two-thirds of all members elected to each house thereof concurring therein) Section 1. Amend Article IV of the Constitution of the State of Delaware by adding a new Section 39 there- to as follows: 39 Senior Judges. section 39. T office o! Senior Judge is hereby created. Any retired judge of a court estab- lished by this amended Article IV of this Constitution or by an act of the General Assembly, who is duly qualified and appointed, may serve as a Senior Judge. The qualifications, manner of appointment, term of office, compensation, duties, and all other matters relating to the office of the senior Judge shall be as specified by statute. Senior judges are subject to the Code of Judicial Conduct and are subject to censure, removal or retirement by the Court on the Judiciary in accordancewith Section 37 of this Article IV. Senior Judges shall not be counted for purposes of determining the political representation On any court or on any combination of courts under section 3 of this Article IV, SYNOPSIS This is the lirat leg of a constitutional amendment that creates the position of Senior Judge.
