T CAPE GAZETTE, Friday, Nov. 19 - Nov. 22, 2004 - 17 Fines raised for repeated violations By Maggie Beetz Revisions to the animal chapter of Rehoboth Beach's municipal code raised fines for people who repeated violate the code, but at the same time decriminalized the charges. Rehoboth Commissioner Mark Aguirre, who also chairs-the Ani- mal Issues Committee, said fines will now be issued in a manner similar to speeding tickets. Aguirre said that police officers were previously reluctant to charge violators because the charge resulted in a criminal of- fense. By decriminalizing animal violations, officers will be more likely to impose fines, he said. Changes to the code, which were passed 5-1 at the commis- sioner's meeting Nov. 15, also in- clude correcting grammatical er- rors and minor semantic changes to ensure that the city licensing code is parallel with the state's. The definition of "animal" was al- so clarified so as to not include human beings. Under the new rules, the city will recognize Trap-Neuter-Re- turn (TNR) as a means for con- trolling the number of feral cats. TNR controls cat populations by sterilizing feral cats before re- turning them to the wild. This pro- gram serves as an alternative to euthanasia. The code previously could have prevented the city from participat- ing in TNR programs, but the re- visions neither prevent nor require TNR, a program that is primarily community-driven. Aguirre said the city does not have the re- sources to hire a fulltime person to trap feral cats. A new trapping section was also added. It prohibits leg traps and regulates use of live traps. Aguirre said that there have been several incidents where traps have cap- tured dogs or cats, which were then left unattended for days dur- ing the summer. The code now requires that all traps identify the name and con- tact information of the trap owner and trapped animals must be re- ported to the city. There were pre- viously no guidelines for using traps; there are still none at the state level. Commissioner Richard Sargent said the new ordinance ."doesn't change much," and voted against it. He said the commissioners "shouldn't pass an ordinance be- cause we worked hard on it," but instead should "work to pass good ordinances." Aguirre said the revised code is a good ordinance that successfully balances animal welfare and ani- mal control without polarizing the community.
