"Jimmy" Lofland Jr., 69, of Milton, passed away Wednesday, Dec. 1, 2010, at the Delaware Hospice Center in Milford. James was born in Milford, son of the late James C. Sr. and Alber- ta (Dorman) Lofland. Jimmy was owner and opera- tor of Lofland's Garage in down- town Milton for more than 30 years and was a school bus con- tractor for the Cape Henlopen School District. He enjoyed stock ear racing arid had driven a dwarf car sever- al years ago. Jimmy was a Navy veteran. He is survived by a daughter: 'Sandy Lofland Payne and grand- son: Joe Payne, both of Tampa, Fla. A funeral service will be held at 10 a.m., Monday, Dec. 6, in the chapel of Short Funeral Services, 416 Federal St., Milton where friends may call from 6 to 8 p.m., Sunday, Dec. 5. Burial will be in Odd Fellows Cemetery, Milton. In lieu of flowers, contribu- tions can be made to Delaware Hospice, 100 Patriots Way, Mil- ford, DE 19963. The Delaware General Assembly has not passed a law allowing the construction of a gambling venue jn Sussex, and the facilities on the books, in- cluding projects in MiUsboro and Georgetown, are either within town limits or areas planned for annexation, said county attorney J. Everett Moore. The county put the moratori- um in place to allow time for staff to update the county's code relating to casinos. Moore said he needed guidance from council. He J. Everett Moore said among the options are writing a specific ordinance for casinos or allowing a conditional use for casino construction. "There is also no ability by the county to regulate the footprint of the building," Moore said, adding it might be prudent to provide new regulations, for all large buildings constructed in the county. He said a key element council must address is where Casinos should be permitted. "Would a conditional use ap- ply to all districts or just com- . mercial and business districts?" Moore asked. Councilman George Cole, R- Ocean View, said the ordinance had to be fo- cused on land use and not the gambling issue. "The or- dinance has to deal with size and location," he said. "We can create regulations in advance of state law," Moore said. He also said different legis- lators give different answers as to whether gambling will be ex- panded to.Sussex. Council voted 5-0 to reintroduce the moratori- um ordinance. "But this time we need to make sure it's placed on an agenda prior to termination," Cole said.
